The following terms set out the agreement between you and us for your application as a contestant on the Programme (this “Agreement”).

Neither we nor the Broadcaster are liable to refund any costs or expenses incurred in applying to participate in the Programme or attending auditions. However reasonable expenses as agreed with the Production will be paid to those candidates selected to appear in the programme.

We do not accept any responsibility for any postal failure or technical failure or malfunction or any other problem with any computer network, system, server, provider, telephony system or otherwise which may result in any application not being properly received.

Only candidates selected to progress in the casting process will be contacted by the Production team.

If selected to appear on the show, you agree to abide by the rules and regulations of the Programme as shall be notified to you in writing and you further accept that our decision is final.

You warrant that you comply with all of the Eligibility Requirements and you agree to provide us with two forms of documentary ID (at least one of which must be photographic for example passport or driving licence) as well as providing all consents and assistance in carrying out any police background searches if so required by us to substantiate the information provided in this application form.

You hereby warrant that you have truthfully and accurately completed this application form and acknowledge and agree that we may in our sole discretion disqualify you from any stage of the Programme auditioning and selection process or the Programme itself at any stage if you supply or have supplied any untruthful, inaccurate or misleading details.

Should you be selected to go through to the next stages of the Programme contestant selection process, you agree that you shall notify us immediately if there are any criminal charges and/or convictions brought against you from the date of this application.

You agree that you will not withhold information from us of any material fact (including but not limited to existing medical conditions) that may in our reasonable opinion jeopardise or otherwise impact on the Programme or which might result in publicity adverse to our good name, the Broadcaster or the Programme. You agree that should you have anything in your history that would bring Mighty Productions Ltd, the Programme or, Broadcaster into disrepute you agree to make us aware of it.

In the event that you are asked to send in an audition video and/ or are selected to appear on the Programme you agree and consent to being filmed in connection with your application and contribution for the Programme. You irrevocably grant and assign us any and all copyright and other rights, title and interest in your Contribution so as to permit the fullest use throughout the world of the Contribution or any part(s) thereof by all means and in all media in connection with the Programme or otherwise in perpetuity. For purposes of clarity, you accept that we have the right to edit, copy, adapt or translate the Contribution as we see fit and you irrevocably waive the benefits of and agree not to assert any provision of law known as "moral rights" or any similar laws of any jurisdiction.

You must own all rights in the photograph that you have submitted with this application form and Mighty Productions Ltd and BBC shall be entitled to copy, edit and/or otherwise use the same at their sole discretion for the purposes of making, selling, promoting, and exploiting the Programme and any other programme or promotional material connected with it in all media.

You hereby grant us the right to use your contribution in connection with the promotion and exploitation of the Programme and/or ancillary products/services and/or in connection with us and/or the broadcaster of the Programme, throughout the world in all media in perpetuity.

Mighty Productions Ltd reserves the right to retain any prizes/winnings if it transpires that information given to us on this form, or at any subsequent stage in the process, is untruthful, inaccurate or misleading.

Mighty is committed to your right to privacy and we adhere to and process data in accordance with the principles set out in the General Data Protection Regulations.

Mighty collects personal information in a variety of ways including via this website, over the telephone, by email and via text in relation to viewer enquiries, general enquiries, applications to take part in our programmes, work experience applications and job applications.

This notice explains what personal data (information) we will hold about you, how we collect it, and how we will use and may share information about you during the application process. We are required to notify you of this information, under data protection legislation.

Please ensure that you read this notice and any other similar notice we may provide to you from time to time when we collect or process personal information about you.

Who collects the information

Mighty Productions limited ("Company") is a "data controller" and gathers and uses certain information about you.

We will comply with the data protection principles when gathering and using personal information, as set out in our Mighty Data Protection Policy.

About the information we collect and hold

The table below summarises the information we collect and hold, how and why we do so, how we use it and with whom it may be shared. Requests for information will be included in programme specific application forms and any consequent interviews.

We seek to ensure that our information collection and processing is always proportionate. We will notify you of any changes to information we collect or to the purposes for which we collect and process it.

Where information may be held

Information may be held at our offices, third party agencies, and/or service providers.

How long we keep your information

We keep the personal information that we obtain about you during the casting process for no longer than is necessary for the purposes for which it is processed. How long we keep your information will depend on whether your application is successful and you become a contributor in a programme produced by us, the nature of the information concerned and the purposes for which it is processed. We will keep casting information for no longer than is reasonable, after which it will be destroyed. If you have not been successful, we may ask you for your consent to keep your information for longer if we think you may be suitable for an alternative programme.

If your application is successful, we will keep your information securely as part of our programme paperwork for as long as is required/justified by law.

Your rights to correct and access your information and to ask for it to be erased

You have the right to access, complete, update, amend and delete the information we hold relating to you.

Keeping your personal information secure

We have appropriate security measures in place to prevent personal information from being accidentally lost,or used or accessed in an unauthorised way. We limit access to your personal information to those who have a genuine business need to know it. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.
